Illinois Shelter in Place Order:  Gov. Pritzker is expected to announce a shelter in place order during his daily address this afternoon. Residents can still go to the grocery store, pharmacies, gas stations and road will be open. COVID-19 Coronavirus - Labor and Employment Implications of the Families First Coronavirus Response Act by Hendrick Phillips Salzman & Siegel

CPS/Construction Criteria Due to COVID-19: CPS has established a list of criteria for work within owned and leased CPS facilities until March 31.

CRCA sending letters to local officials: In addition to NRCA's letter that was sent to the White House yesterday to urge the Trump Administration to deem roofing as an essential service, CRCA is sending letters today to Gov. Pritzker, Mayor Lightfoot, State of Illinois Legislators, and local municipalities to request that CRCA Members can continue to operate their businesses.

The CRCA office has received many questions already Gov. Pritzker's Executive Order (EO). Based on the EO, it appears that individuals in Critical Trades may leave their homes "to perform any work necessary to offer, provision, operate, maintain and repair Essential Infrastructure. Essential Infrastructure "including but not limited to":

  • "...construction...housing construction...building management and maintenance..." (EO Item 9, paragraph 2)
  • Critical Trades: "Building and Construction Tradesmen and Tradeswomen..." (EO Item 12H)

The order also allows those that provide supplies to essential trades:

  • "Businesses that sell, manufacture, or supply other Essential Businesses and Operations with the support or materials necessary to operate..." (EO Item N)

The order also allows those that manufacture and distribute products for essential trades:

  • "Manufacturing companies, distributors, and supply chain companies producing....as well as products used by other Essential Businesses

Worker's Comp: Workers may be entitled to worker’s compensation benefits if they are infected with the coronavirus as a result of employment. Note: Each case, of course, will be extremely fact specific. Ultimately, the employee carries the burden. He or she will have to show that they contracted the virus after an exposure, the exposure was peculiar to work, and that there are no alternative means of exposure demonstrated.

City of Chicago Building Dept. is still open, with a slimmed down staff. They are still working on surveys, inspections and planning. Their intent is to keep projects and planning moving so that there continues to be projects in the pipeline.

NRCA Letter to the White House: NRCA and multiple roofing industry stakeholders have drafted and delivered this letter directly to the White House this morning making the case that “roofing” be included in any definition of “essential services” at the federal level so that our members may continue to operate their businesses.
